Product Warranty

Thank you for choosing ricambilanciafulvia.it. This page outlines the warranty rights applicable to our customers in accordance with Italian and European consumer protection laws.

1) Statutory Warranty of Conformity

• All products sold to private consumers are covered by a 24-month Statutory Warranty of Conformity as provided by the Italian Consumer Code (Legislative Decree No. 206/2005).
• The Statutory Warranty covers any lack of conformity existing at the time of delivery and manifesting within 24 months from that date.
• For purchases made by business companies or professionals (with VAT number), the statutory warranty period is 12 months, as provided by applicable law.

Exclusion for Competition-Use Products

Products intended for racing, competition, or not approved for road use are designed exclusively for sporting purposes. Due to their nature and intended use, such products:

• fall outside the scope of the legal warranty of conformity under the Italian Consumer Code, as they do not qualify as consumer goods intended for “normal use”;
  do not offer durability, continuous performance, or reliability comparable to road-use products, as they are subject to extreme conditions of use;
  • are sold without any Statutory Warranty of Conformity, except for clear manufacturing defects or evident flaws detectable upon delivery;
  • when a product is intended solely for sporting and competition use and is not approved for road use, this is expressly indicated on the product page.

2) Definition of Lack of Conformity

A product is considered to have a lack of conformity if:

• it is not suitable for the purposes for which goods of the same type are normally used;
• it does not match the description provided or lacks the qualities agreed upon;
• it does not possess the usual quality and performance of goods of the same type;
• it is not fit for a particular purpose requested by the Costumer, if accepted by us at the time of purchase.

3) Exclusions from Warranty Coverage

The Statutory Warranty does not cover:

• faults or defects resulting from misuse, negligence, improper installation, lack of maintenance, or failure to follow the manufacturer’s instructions;
• accidental damage, falls, impacts, exposure to weather, or external causes not attributable to the product;
• normal wear and tear and degradation of parts subject to natural deterioration over time (e.g., consumables, friction subject components, etc.);
• unauthorized modifications or alterations made to the product.

4) How to Exercise Warranty Rights

• In case of a lack of conformity, the customer must send a written notice to:

• The following information must be provided: order number; description of the defect; photographic documentation (if available).
• After a preliminary assessment, we may request the product to be returned for further inspection.
• If the defect is confirmed, the customer is entitled—at no additional cost—to:
• Repair or replacement of the product;
• Alternatively, if repair or replacement is not possible or is disproportionately costly, a price reduction or contract termination with refund.

If the defect is confirmed, return shipping costs for the product under Statutory Warranty will be covered by us.

5) Timeframes and Processing

• The customer must report the defect within 2 months of discovery.
• Our company is committed to respond within a reasonable timeframe and to initiate the warranty procedure without undue delay.

6) Manufacturer’s Commercial or Conventional Warranty

In addition to the Statutory Warranty, certain products may be covered by a Manufacturer’s Commercial or Conventional Warranty, such as extended coverage or additional services.

• This Warranty is optional and does not replace the Statutory Warranty.
• Terms, duration, and conditions for claiming the Manufacturer’s Warranty are specified in the documentation provided by the manufacturer and must be exercised directly through the channels indicated therein.

7) Legal Notice

The Statutory Warranty does not limit or replace any consumer rights provided under National and European consumer protection legislation.
