Terms and Conditions of Sale

These Terms and Condition govern purchases made through the website ricambilanciafulvia.it, in accordance with the Italian Consumer Code (Legislative Decree No. 206/2005, as amended), Legislative Decree 70/2003 on electronic commerce, and applicable and currently enforced European Union regulations.

  1. How to place an order
  • Browse the website and add desired items to the “Cart”.
  • Proceed to checkout and follow the on-screen instructions to provide all necessary order details.
  • Prior to confirming the order, a summary will be displayed including selected products, pricing, applicable shipping fees, and available payment methods.
  • The order shall be deemed submitted only upon final confirmation by the customer.
  1. Order Acceptance
  • Upon submission, an automatic email acknowledging receipt of the order will be sent to the customer.
  • This acknowledgement does not constitute acceptance of the order. The seller reserves the right to verify stock availability, accuracy of the information provided, absence of pricing errors, and general compliance of the order.
  • The order is considered accepted and effective only when the customer receives an official shipping confirmation email.
  • In the event of any issues, the Customer Service Team will promptly contact the customer to arrange potential adjustments or cancellations of the order.

Prices and Invoices

  • All prices are listed in Euros (EUR) and are exclusive of VAT.
  • At checkout, VAT will be applied according to the applicable rate in the destination country, where required.
  • For shipments non-EU, VAT is not charged; any customs duties and import taxes are the sole responsibility of the recipient.
  • A valid fiscal document (receipt/sales slip) will be issued for every order.
  • For sales to private customers within the European Union, non-fiscal receipts are issued, indicating the VAT rate applicable in the destination country.
  • An electronic invoice can be issued upon request, only if expressly indicated during checkout, by providing complete and accurate VAT registration details (company name, VAT number, and recipient code/PEC email).
  1. Payment Methods

The following payment methods are accepted (see the “Payment Methods” page for full details):

  • Credit or debit cards via Stripe
  • PayPal (Balance and linked Credit or Debit Cards)
  • PayPal “Pay in 3” (for eligible customers)
  • Advanced Bank Transfer (any fees, transaction and currency conversion charges applied by the customer’s bank are entirely at the customer’s expense).
  • Cash on delivery (only within Italy, with an additional fee)

All payment information is processed securely by third-party providers (Stripe, PayPal) and is not stored or accessible by our website.

  1. Shipping and Delivery

Shipping fees are applied as follows:

  • Italy: flat rate of €13.94 (excl. VAT) for orders up to €950.00; free shipping for orders above this amount.
  • European Union: flat rate of €16.39 (excl. VAT) for orders up to €950.00; free shipping above this amount.
  • Non-EU Countries: flat rate of €100.00 (excl. VAT), regardless of order value.
  • Free in-store pickup is available.
  • Non-standard products by weight/size (as clearly indicated on the product page and during the checkout) may incur significantly higher shipping costs, as they are subject to variations based on the type of goods and fluctuations in transport rates. In such cases, shipping costs cannot be automatically calculated at checkout. We therefore reserve the right to inform the customer of the actual shipping cost after the order is placed. The most cost-effective shipping solution will be identified for each case, and a customized offer will be provided based on the customer’s needs.

  1. Delivery and Inspection Upon Receipt
  • Upon delivery, the customer is required to inspect the condition of the package.
  • In the event of visible damages (damaged, opened, or tampered packaging), the customer must accept the parcel with written control reservation or open the package in the presence of the courier.
  • Failure to follow these procedures invalidate any claims for damage or missing items due to transport.
  1. Right of Withdrawal and Returns
  • The customer is entitled to withdraw from the contract within 14 days from the date of delivery, without providing any reason.
  • To exercise the right of withdrawal, a written communication must be sent to info@rossocorsaitalia.it.
  • Returned items must be intact, unused, and returned in their original packaging.
  • In case of withdrawal, the customer will be refunded the amount paid, including the original standard shipping fees. Return shipping costs are borne by the customer.
  • Defective or non-conforming products are eligible for free replacement or full reimbursement, including return shipping costs.

  1. Legal Warranty

All products are covered by a legal warranty of conformity as provided by the Italian Consumer Code:

  • 24 months for private consumers customers
  • 12 months for business companies or professional customers (with VAT number).

The warranty covers non-conformity defects and does not extend to wear and tear, misuse, or accidental damage.

Legal warranty exclusion for competition products: products intended exclusively for racing or sporting use, or not approved for road use, are not covered by the legal warranty of conformity, except in cases of evident manufacturing defects detectable upon delivery. Any such competition-only use is clearly stated on the product page.

  1. Products Availability
  • In the event of temporary unavailability of any items, the customer will be informed.
  • The customer may choose to wait for restocking or have the unavailable items removed from the order.
  1. Discounts and Offers
  • All listed prices represent our best available offer and are not subject to additional discounts, except for specific promotional explicitly indicated on the website.
  • Any complimentary items or promotional initiatives will be clearly displayed on the product page or during the checkout.
  1. Product Use Disclaimer

Certain items in our catalog are intended solely for racing and competitive use.

In several countries, the use of such products on vehicles driven on public roads is strictly prohibited by current regulations, unless within officially sanctioned motorsport events.

It is the Customer’s sole responsibility to verify in advance the applicable legal and regulatory framework in the country of vehicle registration before installing products intended for racing use on vehicles intended for road use.

Rosso Corsa Italia declines all liability for any improper or unlawful use of its products.

  1. Governing Law and Jurisdiction
  • Contracts made via this website shall be governed by Italian law.
  • For private consumers, jurisdiction shall lie with the courts of the customer’s residence or domicile.
  • For purchases made by business companies or professionals (with VAT number), shall have exclusive jurisdiction the court of Genoa (Italy).
